DMCA Policy

Italia Bosnia Quando ("we," "us," or "our") respects the intellectual property rights of others and expects its users to do the same. This Digital Millennium Copyright Act ("DMCA") Policy describes how we respond to alleged copyright infringement and how copyright owners can submit a notice of infringement. We comply with the provisions of the DMCA, 17 U.S.C. § 512, which provides a mechanism for copyright owners to notify online service providers of alleged copyright infringement.

It is our policy to respond to clear notices of alleged copyright infringement that comply with the DMCA. If we receive a DMCA compliant notice, we will take down the material or block access to it, and may terminate the accounts of repeat infringers. Users who believe their content was mistakenly removed may file a counter-notification.

Filing a DMCA Notice

If you are a copyright owner or an agent thereof and believe that any content hosted on Italia Bosnia Quando infringes upon your copyrights, you may submit a notification of claimed infringement by providing our Designated Copyright Agent with the following information in writing (please consult your legal counsel or see 17 U.S.C. § 512(c)(3) to confirm these requirements):

  1. Identification of the copyrighted work claimed to have been infringed: This must include a description of the copyrighted work, and a copy of or the location (e.g., URL) of an authorized version of the copyrighted work.
  2. Identification of the material that is claimed to be infringing: This must include a description of the material and information reasonably sufficient to permit Italia Bosnia Quando to locate the material (e.g., URL(s) of the allegedly infringing material on Italia Bosnia Quando).
  3. Information reasonably sufficient to permit Italia Bosnia Quando to contact the complaining party: This includes your full legal name, mailing address, telephone number, and email address.
  4. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Counter-Notification

If you believe that your content was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with our Designated Copyright Agent by providing the following information in writing (please consult your legal counsel or see 17 U.S.C. § 512(g)(3) to confirm these requirements):

  • Identification of the material that has been removed or to which access has been disabled: This must include the URL(s) where the material appeared before it was removed or disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside of the U.S., for any judicial district in which Italia Bosnia Quando may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • Your physical or electronic signature.
